By accessing or using the TIRwork platform (the "Service"), including our website and mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and TIRwork S.r.l., a company registered in Milan, Italy. By creating an account, you confirm that you have read, understood, and accepted these Terms in their entirety.
TIRwork is a digital marketplace that connects transport companies with qualified truck drivers across Europe. The platform provides AI-powered matching technology that analyzes driver qualifications, licenses, experience, geographic preferences, and availability to generate compatibility scores between candidates and job listings. TIRwork facilitates the connection between parties but does not act as an employer, staffing agency, or intermediary in the employment relationship. Any employment agreements are made directly between the transport company and the driver. The Service is available in multiple languages, including English, Italian, Romanian, Arabic, and Albanian.
To use TIRwork, you must create an account by providing accurate and complete information. There are two types of accounts: Driver accounts (free of charge) for individuals seeking truck driving employment, and Company accounts for transport companies seeking to hire drivers. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account. You agree to notify TIRwork immediately of any unauthorized use of your account. TIRwork reserves the right to verify the information provided during registration and to request additional documentation, including but not limited to driving licenses, CQC certificates, ADR certifications, and company registration documents.
While driver accounts are free, transport companies must subscribe to a paid plan to post job listings and access candidate profiles. TIRwork offers three subscription tiers: Starter, Professional, and Enterprise, each with different features and limits. All payments are processed securely through Stripe. Subscriptions are billed on a monthly basis and automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing cycle. Refunds are not provided for partial billing periods. TIRwork reserves the right to modify subscription pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
As a user of TIRwork, you agree to: (a) provide accurate, truthful, and up-to-date information in your profile and job listings; (b) not misrepresent your qualifications, licenses, experience, or any other information; (c) comply with all applicable local, national, and European Union laws and regulations, including but not limited to employment law, transport regulations, and data protection legislation; (d) not use the Service for any unlawful, fraudulent, or harmful purpose; (e) not attempt to circumvent the platform to avoid subscription fees; (f) not scrape, harvest, or collect data from the platform by automated means; (g) treat all other users with respect and professionalism in all communications through the platform. Violation of these obligations may result in immediate suspension or termination of your account.
The TIRwork platform, including its design, software, algorithms, AI matching technology, logos, trademarks, and all associated content, is the exclusive property of TIRwork S.r.l. and is protected by Italian and international intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works of any part of the platform without prior written consent. Users retain ownership of the content they submit to the platform (profiles, job descriptions, messages, documents). By submitting content, you grant TIRwork a non-exclusive, worldwide, royalty-free license to use, display, and process such content solely for the purpose of providing and improving the Service.
TIRwork uses artificial intelligence and algorithmic matching to generate compatibility scores between drivers and job listings. These scores are provided for informational purposes only and are intended to assist users in their decision-making process. Match scores do not constitute a recommendation, endorsement, or guarantee of suitability for employment. TIRwork does not guarantee the accuracy, completeness, or reliability of AI-generated match scores. Hiring decisions should be made based on the company's own independent evaluation, including interviews, document verification, and any other due diligence the company deems necessary. TIRwork shall not be held liable for any hiring decisions made based on AI match scores.
To the maximum extent permitted by applicable law, TIRwork S.r.l. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, but is not limited to, damages for loss of profits, data, business opportunities, or goodwill. TIRwork does not guarantee continuous, uninterrupted, or secure access to the Service. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. TIRwork's total liability for any claims arising from or related to the Service shall not exceed the amount paid by you to TIRwork in the twelve (12) months preceding the claim. Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
TIRwork reserves the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, provided false or misleading information, or otherwise acted in a manner that is harmful to the platform, other users, or TIRwork's interests. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through your account settings. Data retention following account deletion will be handled in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).
These Terms shall be governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Milan, Italy. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr, which consumers may use to resolve disputes.
TIRwork reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the platform and updating the "Last updated" date at the top of this page. For significant changes, we may also send a notification to your registered email address. Your continued use of the Service after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and delete your account.
